Terms of Service

1. Agreement to Terms

By accessing or using the Ping Hunt mobile application or website at www.pinghunt.com (together, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Eligibility

You must be at least 13 years old (or 16 in certain jurisdictions) to use the Service. By using the Service, you represent that you meet this age requirement. If you are under 18, you must have your parent or guardian's permission.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently or harmfully.

You may delete your Ping Hunt account at any time from within the app. For step-by-step instructions and details on what data is removed, see our account deletion page.

4. The Service

Ping Hunt allows users to create GPS-based scavenger hunts with photo-matching waypoints, participate in hunts created by others, and share hunts with the Ping Hunt community. Features may change over time.

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice.

5. Location Services

The Service requires access to your device's GPS location to function. By enabling location permissions, you consent to the collection and use of your precise location data as described in our Privacy Policy.

You are responsible for your own safety when using the Service in the real world. Always be aware of your surroundings and comply with all applicable laws regarding trespass and access to locations.

6. User Content

a) Your Content

You may submit photos, create hunts, and provide other content through the Service ("User Content"). You represent that you own or have the necessary rights to submit your User Content and that it does not violate any third party's rights.

b) Licence to Ping Hunt

By sharing a hunt or image on the Service, you grant Ping Hunt a perpetual, irrevocable, worldwide, royalty-free, fully sublicensable licence to use, reproduce, modify, adapt, publish, distribute, and create derivative works from that User Content for any purpose, including commercial use, in connection with operating and promoting the Service.

c) Ownership After Sharing

Once you share a hunt, waypoint image, or GPS data through the Service, that content and the associated data (including location coordinates and photographs) become the property of Ping Hunt. Ping Hunt may use this data to improve the platform, generate map data, train machine-learning systems, or make it available to other users of the Service.

d) Content Standards

You must not submit User Content that:

  • Is unlawful, defamatory, obscene, or offensive
  • Infringes any intellectual property or privacy rights
  • Contains personal information of others without their consent
  • Encourages trespass or illegal activity
  • Is spam, misleading, or deceptive

7. Prohibited Conduct

When using the Service, you agree not to:

  • Violate any applicable laws or regulations
  • Interfere with or disrupt the Service or its servers
  • Attempt to gain unauthorised access to any part of the Service
  • Use the Service to harass, bully, or harm other users
  • Use automated tools to scrape, crawl, or extract data from the Service
  • Create hunts that direct participants to dangerous or restricted locations
  • Reverse engineer or attempt to extract the source code of the app

8. Intellectual Property

The Service, including its design, code, graphics, and branding, is owned by Ping Hunt and protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the Service without our prior written consent. User Content shared on the platform is owned by Ping Hunt as described in Section 6(c).

9. Third-Party Services

The Service may contain links to or integrate with third-party services (such as app stores or mapping providers). We are not responsible for the content or practices of those third parties, and your use of them is subject to their own terms and privacy policies.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses.

Ping Hunt is not responsible for any harm, injury, or damage that occurs while you are participating in a hunt in the real world. Always prioritise your personal safety.

11. Limitation of Liability

To the fullest extent permitted by law, Ping Hunt and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages.

12. Indemnification

You agree to indemnify and hold harmless Ping Hunt and its directors, employees, and affiliates from any claims, losses, or damages (including legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Ping Hunt operates, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of that jurisdiction.
